Regulations

The Manual Handling Operations Regulations 1992 establish a clear hierarchy of measures that all employers must comply with the following:

(a) Avoid hazardous manual handling operations so far as is reasonably practicable;

(b) Assess any hazardous manual handling operations that cannot be avoided; and

(c) Reduce the risk of injury so far as is reasonably practicable.

Self-employed

Section 2 states that:
"Any duty imposed by these regulations on an employer in respect of his employees shall also be imposed on a self-employed person in respect of himself."

If you look into cases where the HSE have taken action against organisations / employers, whether it is an improvement notice or a prosecution, the lack of manual handling risk assessments, staff training and the lack of provision of equipment to avoid or reduce manual handling will be the reasons behind the HSE action.
